A constitutional ballot initiative proposed by Make It Legal Florida regarding marijuana legalization faced a setback as Attorney General Ashley Moody deemed it misleading. The initiative sought to allow Florida voters to decide on permitting individuals aged 21 and older to possess and consume up to 2.5 ounces of marijuana. Despite raising $8.2 million and garnering over 556,000 signatures, falling short of the required total, the initiative was rejected. To proceed, Make It Legal Florida must draft a new amendment.

Representing Make It Legal, attorney George Levesque reached out for comment, but received no response from the organization’s chairman, Nick Hansen. In an unsigned opinion, five of seven justices criticized the use of the term “permit” in the initiative’s summary, arguing that it failed to clarify that marijuana possession and consumption would remain illegal federally, despite state legalization.

Similar issues arose during previous Florida Supreme Court cases, notably during the 2016 medical marijuana legalization initiative. Some observers, like Ben Pollara, who led the 2016 campaign, interpreted the Court’s decision as reflective of a right-leaning shift under Governor Ron DeSantis. Notably, three justices appointed by DeSantis voted against Make It Legal Florida’s initiative, which faced opposition from both the Florida House and Senate.

While states like New Jersey, New York, Virginia, and New Mexico have recently legalized marijuana, with others allowing recreational use, Florida’s initiative encountered legal hurdles, highlighting ongoing debates surrounding marijuana legalization.
